Direct purchase by value in 2026: the caps in force until December and what changes next year
Decree 12,807/2025 set the 2026 cap for direct purchase by value at R$ 65,492.11 (goods and services) and R$ 130,984.20 (works and engineering). How to use it in the last quarter, and why to check the 2027 figure in January.

The 2026 figures
Since January 1, 2026, Brazilian public bodies may buy without a full tender when the value is below R$ 65,492.11 for common goods and services (Law 14,133, art. 75, II) and below R$ 130,984.20 for works, engineering services and vehicle maintenance (art. 75, I). The figures come from Decree 12,807 of December 29, 2025, published in the Official Gazette on 12/30/2025, which revoked the previous year's decree.
For public consortia and executive agencies the caps double (art. 75, § 2).
Why the last quarter matters
The cap is counted per fiscal year and per object of the same nature. In October and November many agencies still have budget and room under the cap for small purchases, and electronic direct purchases often run on a notice of just three business days (art. 75, § 3). Suppliers who don't watch notices daily miss the window.
- Set alerts on the words that describe what you sell, not only on agency names.
- Keep tax certificates and registrations current: the deadline is too short to fix them later.
- Check that the estimated value fits under the cap; above it, the route is a pregão or concorrência.
What about 2027?
The same decree delegated future updates to the Ministry of Management and Innovation (art. 3). So the 2027 cap should come from a ministry act, not a new decree. Check PNCP and the Official Gazette in early January before pricing small bids.
