What changed
The Office of the Attorney General of the National Treasury (PGFN) published Settlement-by-Adhesion Notice PGDAU 10 of 30 September 2026 in the Official Gazette on 1 October. It reopens notice 6/2026 from 8 a.m. on 1 October 2026 until 7 p.m. on 29 January 2027, Brasília time.
The same act extended Desenrola MEI (notice 9/2026) to 29 January and the family farming notice (8/2026) to 20 December 2026. Taxpayers simulate and sign up themselves on the Regularize portal, with no intermediary.
Why it matters if you bid for public contracts
Law 14,133/2021, article 68, includes good standing with the federal tax authorities in the tax qualification stage. Article 91, paragraph 4, requires the agency to check tax standing again before signing and before extending a contract. A registered federal debt without a settlement can knock a company out of a tender or block the renewal of an existing contract.
Under Law 13,988/2020, article 3, paragraph 2, a settlement that includes installments suspends the enforceability of the debt, as set out in article 151 of the National Tax Code. With enforceability suspended, article 206 of the Code gives a positive certificate the same effect as a clean one.
Who can join and on what terms
- Debts registered in federal active debt by 3 July 2026, with a consolidated total of up to R$ 45 million.
- Payment capacity: down payment of 6% of the total in up to 6 installments, or 12 for MEI, micro and small companies, and the balance in up to 114 months, or 133 for MEI, micro and small companies. In ratings C and D, up to 100% off interest, fines and charges, capped at 65% of the debt, or 70% for MEI, micro and small companies.
- Small-value debts for MEI, micro and small companies and individuals, registered by 1 October 2025 and up to 60 minimum wages: 50% off paid upfront or within 7 months, down to 30% over 55 months.
- Paying upfront waives the down payment. Social security debts remain limited to 60 installments under the Constitution.
- Minimum installment of R$ 25 for MEI and R$ 100 for everyone else.
The mistakes that sink the deal
- The first installment must be paid by the last business day of the month you sign up. Without it, the request is rejected.
- The settlement must include every eligible registered debt that is not secured, already in installments or suspended by a court.
- If the debt is being disputed in court, proof of withdrawal must be filed within 60 days.
- Three late installments, in a row or not, terminate the deal: the company loses the discounts and cannot settle again for two years, even for other debts.
How to fit it into your tender calendar
Do not leave it for the week of the session. Simulating, signing up, paying the first installment and seeing the result on the certificate takes a few days, and qualification looks at the certificate valid on that date. If you are targeting tenders in November and December, sort out the debt now and put the installments on automatic debit.
Federal standing is only one part. Qualification also asks for FGTS and Labour Court certificates and, depending on the notice, state and city tax standing. Read each notice's document list before counting on the contract.
